Terms of Service

These Terms of Service ("Terms") govern your use of services provided by EPIC Communications Inc ("EPIC," "we," "us," or "our"), including broadband internet, VoIP, and AI-powered services. By subscribing to or using any EPIC service, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services

EPIC provides the following services subject to availability in your area:

  • Broadband Internet: Fixed wireless, LTE, and 60GHz connections
  • VoIP / Voice Services: Local, regional, and international calling
  • AI Business Services: AI-powered agents, automation, and business intelligence tools
  • Bundled Plans: Combined internet and voice packages

Services are provided on a best-efforts basis. Coverage areas and speeds are subject to network conditions, terrain, and infrastructure availability.

2. Account & Eligibility

  • You must be at least 18 years old to enter into a service agreement with EPIC.
  • You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorized use.
  • You may not transfer or resell EPIC services to third parties without prior written consent.
  • Business accounts must be registered under a valid business name or sole trader identity.

3. Billing & Payment

  • Services are billed monthly in advance unless otherwise stated.
  • Broadband and VoIP plans are priced in Eastern Caribbean Dollars (XCD). AI service plans are priced in United States Dollars (USD).
  • Invoices are due on or before the due date shown. Late payment may result in service suspension after a grace period of 7 days.
  • Reconnection following suspension for non-payment may incur a reconnection fee.
  • EPIC reserves the right to adjust pricing with 30 days' written notice.
  • All payments are non-refundable except where EPIC has failed to deliver the agreed service.

4. Acceptable Use

You agree not to use EPIC services to:

  • Transmit, distribute, or store material that is illegal, harmful, threatening, defamatory, or infringes on intellectual property rights
  • Send spam, unsolicited bulk communications, or conduct phishing activities
  • Conduct port scanning, network intrusion, or distributed denial-of-service (DDoS) attacks
  • Resell or share services in a manner that degrades the network for other customers
  • Violate any applicable law or regulation of the Commonwealth of Dominica or applicable international standards

Violation of this acceptable use policy may result in immediate service suspension without refund.

5. Service Levels & Uptime

EPIC targets 99% network uptime on a monthly basis. Planned maintenance will be communicated with at least 24 hours' notice where possible.

Service interruptions due to the following are not covered by uptime guarantees:

  • Acts of God, natural disasters, or severe weather (common in Dominica — we understand the environment)
  • Damage to customer equipment or premises wiring
  • Actions by third-party carriers or upstream providers
  • Government-directed service restrictions

For extended outages caused by EPIC infrastructure failure exceeding 48 hours, customers may request a pro-rated service credit.

6. Equipment

  • EPIC-provided equipment (routers, radios, antennas) remains the property of EPIC and must be returned upon service cancellation.
  • You are responsible for reasonable care of installed equipment. Damage beyond normal wear and tear may be charged at replacement cost.
  • Do not tamper with, move, or modify EPIC-installed equipment without authorisation.
  • You grant EPIC authorised personnel access to your premises for installation, maintenance, and recovery of equipment.

7. AI Services — Additional Terms

EPIC's AI services are powered by third-party AI platforms. By using these services:

  • You acknowledge that AI-generated outputs may not always be accurate and should be reviewed before acting on them in critical business decisions.
  • You retain ownership of your data; EPIC does not use your business data to train AI models.
  • You must not use AI services to generate illegal content, impersonate individuals, or engage in fraud.
  • AI service availability is subject to the uptime of underlying third-party platforms. EPIC is not liable for third-party AI provider outages.

8. Cancellation & Termination

  • You may cancel your service at any time with 30 days' written notice to info@epic.dm.
  • EPIC may suspend or terminate service immediately for: non-payment, acceptable use violations, fraudulent activity, or legal/regulatory requirements.
  • Upon cancellation, all outstanding balances become immediately due.
  • EPIC-owned equipment must be returned within 14 days of service termination. Unreturned equipment will be invoiced at replacement cost.

9. Limitation of Liability

To the maximum extent permitted by law, EPIC's total liability for any claim arising from these Terms or use of our services shall not exceed the total fees paid by you in the 3 months preceding the claim.

EPIC is not liable for: indirect, incidental, or consequential damages; loss of business or revenue; or data loss arising from service interruption.

10. Governing Law & Disputes

These Terms are governed by the laws of the Commonwealth of Dominica. Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to mediation or arbitration under applicable Dominica law before litigation.

Regulatory complaints may also be directed to the National Telecommunications Regulatory Commission (NTRC) of Dominica.

11. Changes to These Terms

EPIC may update these Terms from time to time. We will provide at least 30 days' notice of material changes via email or website notice. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
